What the waiver covers
- Recital of non-commercial nature. The outing is a private guest experience, not a paid service. No fee is charged.
- Assumption of risk. You acknowledge recreational boating risks including weather, wake, equipment, vessel traffic, hypothermia, and drowning.
- Release and waiver. You release the host from ordinary negligence to the maximum extent enforceable under Illinois law. Gross negligence and willful misconduct are not waived.
- Cost-share acknowledgment. You agree that any reimbursement is optional, proportional, and capped at actual documented cost.
- Safety compliance. You agree to wear a life jacket when required, follow captain's instructions, and refrain from illegal substances aboard.
- Photo and media consent. You consent to photos taken aboard being used privately by the host; they will not be used in any public advertising.
- Minor addendum. If you are bringing a minor, the parent or guardian signs a separate addendum.
- Medical authorization. You consent to emergency medical treatment if you are incapacitated.
- Indemnification. You indemnify the host for your own misconduct.
- Governing law. Illinois choice of law; Cook County venue for any dispute.
When you sign
After the host approves your request, you receive the finalized waiver via e-signature link. You sign before you board — no exceptions. Every adult guest signs individually.
